1. Who we are
HeroLap (“HeroLap,” “we,” “us”) operates a marketplace that connects drivers (“Drivers”) with motorsport coaches (“Instructors”) for asynchronous video reviews and live coaching sessions. By creating an account or otherwise using HeroLap (the “Service”), you agree to these Terms.
If you are using HeroLap on behalf of a team, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
2. Eligibility & accounts
You must be at least 16 years old to create an account. If you are under 18, a parent or guardian must agree to these Terms on your behalf, and is responsible for your activity on the Service.
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
3. The Service
3.1 Async lap reviews
Drivers upload in-car video and (optionally) telemetry data. An Instructor reviews the lap and delivers voice notes, drawn lines on a track map, and timestamped feedback. Each review has a turnaround target set by the Instructor.
3.2 Live coaching sessions
Instructors publish live coaching products and time slots. Drivers book a slot and meet the Instructor at the scheduled time over Discord or the agreed simulation platform.
3.3 Bundles
Instructors may offer multi-session bundles at a discount. A bundle purchase is a single charge that produces redeemable credits. Credits are tied to one Instructor and one product/tier and do not transfer between Instructors.
4. Marketplace role
HeroLap is a marketplace. We are not the provider of coaching services. Instructors are independent contractors, not employees or agents of HeroLap. We do not control, endorse, or guarantee the coaching, opinions, advice, or recommendations of any Instructor.
You acknowledge that motorsport is dangerous. Coaching feedback is guidance only — you are responsible for your own driving, vehicle, equipment, and safety on every track or sim platform.
5. Payments & payouts
Payments are processed by Stripe through Stripe Connect. By using the Service you also agree to Stripe’s consumer terms and (for Instructors) the Stripe Connected Account Agreement.
HeroLap charges a platform fee on each transaction (currently 15% of the gross amount). The remainder is paid to the Instructor on the delivery cycle described in section 7. Bundle purchases collect the platform fee on the full bundle amount upfront.
Prices are displayed in U.S. dollars and exclude any applicable taxes, which are the Driver’s responsibility unless explicitly stated.
6. Cancellations & refunds
6.1 Async reviews
Drivers may cancel an order for a full refund any time before the Instructor accepts it. After acceptance, refunds are at the Instructor’s discretion or by HeroLap intervention if the review materially fails to meet the tier description.
6.2 Live sessions
Drivers and Instructors may cancel a booked live session any time before it starts. Cancellations return the bundle credit if one was used, or refund the full amount paid otherwise. No-shows are not refunded.
6.3 Bundle refunds
Unused bundle credits are refundable on a pro-rata basis within 90 days of purchase by emailing [email protected]. Used credits are not refundable.
7. Hold period & payout release
Driver payments are held by Stripe in escrow on the Instructor’s Connected Account until the review or session is delivered and a seven-day hold period passes without a substantiated dispute. After that, payouts are released on Stripe’s standard schedule.
8. Driver content
You retain ownership of any video, telemetry, photos, and notes you upload (“Driver Content”). By uploading Driver Content you grant HeroLap and the assigned Instructor a non-exclusive, worldwide, royalty-free license to host, store, process, transcode, transcribe, and display the content for the purpose of delivering the Service to you.
You represent that you have all rights necessary to upload the Driver Content and that it does not infringe any third party’s intellectual property, privacy, or publicity rights.
9. Acceptable use
You agree not to:
- upload content depicting clearly illegal activity;
- impersonate another person, team, or organization;
- scrape, reverse engineer, or interfere with the Service;
- circumvent the platform fee by routing payment off-platform;
- harass, threaten, or abuse another user; or
- use the Service to violate any applicable law.
We may suspend or terminate accounts that violate these rules. We may also remove specific content (including profile or cover photos) that we determine, in our reasonable judgment, is inappropriate for the platform.
10. Instructor obligations
Instructors must (a) hold themselves out honestly about their experience and qualifications, (b) deliver reviews and live sessions in line with their published tier descriptions, (c) keep their availability current, and (d) comply with Stripe’s Connected Account terms and any applicable tax-reporting requirements.
11. Intellectual property
The Service, including its design, code, brand marks, and aggregated data, is owned by HeroLap and protected by intellectual property laws. Nothing in these Terms transfers any HeroLap intellectual property to you.
12. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that coaching feedback will improve your lap times, that videos will be free of artifacts, or that the Service will be uninterrupted or error-free.
13. Limitation of liability
To the maximum extent permitted by law, HeroLap, its officers, and employees will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, revenues, or data arising out of your use of the Service. Our aggregate liability for any claim is capped at the greater of the amounts you paid HeroLap in the 12 months preceding the claim, or US$100.
14. Indemnification
You agree to defend and indemnify HeroLap from any claim arising out of your Driver Content, your violation of these Terms, or your violation of any third-party right.
15. Termination
You may close your account at any time by emailing [email protected]. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be emailed to the address on your account at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance.
17. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Disputes will be resolved in the state and federal courts located in Delaware.
